West Bengal is the country’s leader in land reform. Looking back, the Regulation of 1793 established the Zamindary system with full proprietary rights in the land subject to the payment of land revenue. The Bengal Tenancy Act became law in 1885. This legislation aimed to consolidate various land-related statutes. The Board of Revenue emerged in 1786. This Board was the supreme authority over the state’s entire land revenue administration. Following independence on August 15, 1947, the West Bengal government promulgated the West Bengal Estate Acquisition Act 1953, which abolished all intermediary interests. A large amount of land was vested. The West Bengal Land Reforms Azt of 1995 followed, and families were the basis of ceilings. Contrary to all other states, the state has distributed 23% of the total land sent into the country and 53% of the beneficiaries. West Bengal has registered over 15 lakh Bargadars/ Sharecroppers, a first in the country, and has distributed homestead land to over 5.6 lakh beneficiaries. How to Get Land Record Information in West Bengal

The West Bengal government launched Banglarbhumi, an online web portal for land records and reforms. Anyone can use this portal to obtain land and property-related information, such as the owner’s name, land area, plot number, property value, and current owner. 

Details about the land/ property are critical to the buyer or owner of the land/ property.

As a precaution, if a person wishes to purchase any land/property, he should inquire about the information. 

These details could be as simple as who registered the land or who is the current owner. 

The Banglarbhumi portal provides this data alongside a land map for land/ properties in West Bengal. It also helps entrepreneurs who want to establish new industries in the state by informing them about the infrastructure available at the proposed location. Someone can also retrieve information about his block by entering the district and block details. 

Deed Registration 

A property registration deed is a binding contract signed by two parties. When the property goes in the buyer’s name, they become the legal owners. This contract, known as the purchase/land deed, must be signed with the government. 

A purchase /land deed can be registered here. The e-appointment for signing up for this deed can be on the same website.

 E-payment is required for both registrations if the stamp duty payable on the deed exceeds Rs. 10,000/- and the registration fee due exceeds Rs. 5000/-, or both.  

This registration procedure is linked to the Income Tax Department, allowing PAN verification at the point of registration.

Application for Mutation Online

A mutation is a process of changing the title/ownership of property from one person to another when the property goes on sale. However, only when a property is registered can the mutation process begin. 

The mutation form is available on the Banglarbhumi web portal. Here, 

  • To avoid application rejection, the user must correctly fill out all the required information. Fill out the form completely and submit it. 
  • Upon submission of the mutation form, a reference number is assigned to the application. 
  • The user can use this application number to check the status of the application. 
  • Following registration, the user can pay the fee via the ‘Online Application Menu’ by selecting the ‘Fees Payment’ option. 
  • Before proceeding to the payment option chosen, the user must primarily enter the request type and application number. 
  • The mutation case number is immediately registered if the user pays the fees in ‘online mode’ (debit card/net banking). 
  • Assume the user pays the fees via the ‘counter payment’ option (offline). In this case, the user can check the status of his payment and registration by selecting the ‘Application-GRN Search’ option from the ‘Online Application’ menu.

Online request for a certified copy of plot information/Record of Right (ROR)/ plot map

West Bengal residents can obtain certified copies of the plot information/ROR/plot map by following these simple steps:

  • Navigate to http://banglarbhumi.gov.in/
  • Log in to your account by clicking on the ‘Citizen services’ tab. 
  • Choose the ‘Service delivery option’ from the menu bar. 
  • Select your requirement-ROR Request/Plot Info Request/Plot map from the ‘Service Delivery option’ in the menu bar. Request/ Request GRN search/ Reprint Application/ Receipt. 
  • After selecting the required option, they will be taken to a new page where they will be required to fill out the requested information. By clicking on ‘calculate fee,’ you can also automate the calculation of fees. 
  • In this case, online payment is required.

Follow these steps to obtain information about property/ land records: 

  • Navigate to the Banglabhumi website’s homepage and select “Know Your Property” from the Citizen Service menu. 
  • Enter district, block, and village information. 
  • Use the ‘Khaitan number’ or plot number to find the data you require. 
  • The user will receive the required details once the appropriate number is submitted and matched with the records.

When you go to the ‘Query Search’ tab on the Banglarbhumi home page, you can also lookup for land records in West Bengal information about your query. Simply enter the query number and year. Enter the captcha to view the details on Banglabhumi.

How do I check the RS – LR information on the Baglarabhumi website?

Process of Property Registration

We’ll discuss some of the main points on the entire process of registration of a property in India. Although this process is quite complex, it may require a lot of time and effort by the registry office to complete. So let’s start the process of registering a property in India with propertywala.

Karnataka Property Registration - Procedure and Charges - IndiaFilings

STEPS OF PROPERTY REGISTRATION IN INDIA:

  1. The first step is to choose the property and look for all the details in the property. Negotiate with the seller. Pay 10% booking amount. Then we have an agreement to sell.
  2. Buyers should check that there are no liens or other encumbrances on the property before they make an offer.
  3. Calculate Stamp Duty. Stamp Duty is the tax levied on the transfer of real property in the state. Stamp duty rates vary from state to state. It’s calculated either on the circle rate or on the market rate, whichever is higher. It’s generally 3-10% of the property value and 1% is the registration charge.
  4. There are three methods for paying stamp duty, as follows:
    1. Method 1 – Non-Judicial stamp paper (picture). If stamp duty is Rs. 1 lakh, buy papers worth Rs 1 lakh, where sale deed will be printed on an official stamp paper.
    2. Method 2 – Franking method – Print the sale deed on plain paper. Pay stamp duty in the cheque, cash, online, or DD draft. Then the bank attests to the sale deed.
    3. Method 3 – E-Stamping (picture) – it will mention all details – generated online – Go to Stock holding corporation of India – www.shcilestamp.com. Payment will be made only at authorized centers. Collect e-stamp then.

HOW TO CALCULATE STAMP DUTY:

Now, buyers should also be aware of the Stamp duty calculation. They should also know that this tax is payable when they register their property.

For example, if the actual value is Rs. 40 lakhs and the circle rate is Rs. 50 lakhs, then you have to pay stamp duty at the highest rate out of the two. Hence, in this example, because the circle rate is greater than the actual rate then you have to pay a stamp duty of Rs. 50 lakhs.

And in another case, let’s assume that you bought a property in India with a market value of Rs 90 lakhs and the circle rate was Rs 80 lakhs. In this case, you would have to pay a stamp duty of Rs 90 lakhs. Therefore, you can calculate your stamp duty. In addition, you can also estimate stamp duty online because it varies differently and is higher in large cities and towns than in small towns or cities.

5. The next thing is a draft and print sale deed or conveyance deed, or gift deed. It mentions all details like name, address, age of both the buyer and seller, etc. It provides details about payment, including through cheque, cash, or any other method. After that, you have to print the sale deed on stamp paper and then sign each page of the sale deed. Two witnesses also have to sign the last page of the sale deed.

6. After drafting and printing the sale deed, you must register it at the sub-registrar office. The office should be located in a fixed zone of your property’s locality. To schedule an appointment online or to obtain a token number, contact the sub-registrar office by phone or in writing. Both buyer and seller should attend the registration; witnesses should be present as well. If either of them cannot attend, they must appoint someone to act on their behalf with power of attorney. All parties should bring documents such as an Aadhaar card and an identity document. Three photographs will be attached to the sale deed, and both buyers and sellers will be asked to sign their names in the presence of a sub-registrar. Fingerprints will also be taken for security purposes.

7. After that, you have to collect the registered sale deed. The deed can be collected within 15-20 days. If you took a bank loan, the bank will collect the original deed.

8. Now that the registration process is over and the property transfer is complete, you need to change the name in the land records. This process is called a mutation. If your property is located in a rural area or outside municipal limits, you will have to change the name in land records. The mutation has different names in different states. For example Jamabandi in Haryana, Punjab, and Rajasthan; Khatauni in Uttar Pradesh; 7/12 in Gujarat and Maharashtra; and Khatian in Orissa, West Bengal, and Bihar. After you register your property, the whole process of registration of your property is completed.

Bengal Urban Land Policy: Seeks 30% Reservation for Low-Cost Housing

The promise of Ma, Mati, and Manush governance by Mamata Banerjee may fall short of the second M-word, meaning land — at least for real estate developers in the state’s capital city. For, the West Bengal government has now decided to bring in an amendment to the Urban Land (Ceiling and Regulation) Act (ULCA), 1976, an eyesore of developers for quite some time. The proposed alteration will stipulate the developers to reserve 30 per cent apartments in big housing projects for the low-income group (LIG). Industrialists have been seeking a total repeal of the Act, introduced in 1976 to prevent hoarding or excessive holding of land in urban centres.

According to the Act, the ceiling limit on vacant land in a category ‘A’ city like Kolkata is 7.5 cottah or about 500 square meters. The demand for repealing the ULCA was raised for the first time by Godrej Properties chairman Adi Godrej, at an industry meet within the first month of Banerjee taking over the chief minister’s office.

Much to the disappointment of the developers, urban development minister Firhad Hakim has now totally ruled out the possibility of repealing the Act. “We are not going to abolish the Land Ceiling Act,” he said. “Instead, we will give permission to developers for purchase of land beyond ceiling, provided they reserve 30 per cent housing for low-income housing segment.”

As for the Trinamool dispensation, it has also decided to do away with the concept of public-private partnership (PPP) — an idea pioneered by the earlier Left Front government under Buddhadeb Bhattacharjee. Instead, “the government will allocate land to the highest bidder and for the rest of the big projects the state will build on its own,” according to Hakim. Notably, in spite of the Land Ceiling Act, the earlier government had windfall gains by allotting land in prime areas of city.

For example, three prominent government agencies involved in land deals in and around Kolkata — the Kolkata Metropolitan Development Authority (KMDA), Kolkata Municipal Corporation and West Bengal Housing Board— signed deals worth more than Rs 18,000 crore, for over 5,250 acres of land during the period in little over two years. In fact, KMDA was credited with signing deals, worth more thanRs 800 crore with real estate developers on a single day. “The process of land allotment slowed substantially over the last two years. First, it was due to elections,” said a city-based real estate developer. “Second, it was due to lack of vision and policy of the new government.”
